• Will I still be an employee of Miami-Dade County?

  With the passage of Amendment 10 to the Florida Constitution, it is anticipated that most County employees employed by MDPD, Finance, Tax Collector, Property Appraiser, Clerk of Courts, and Elections (“Affected Departments/Offices”) will no longer be employees of the County but will become employees of one of the Constitutional Offices (CO) on January 7, 2025 (Effective Date). Beginning on the Effective Date, employees that have been transferred to a CO will then be under the direction and supervision of a Constitutional Officer.

• Will I be offered the same salary and pay supplements?

  The Mayor plans to propose transition agreements to the Constitutional Officers that will provide for the CO to maintain salary and additional pay supplements for all transferred employees (Non-Bargaining and Bargaining Unit employees). The new elected official will have the option of accepting this proposal from the Mayor or not as part of the transition process.

• What happens to my Florida Retirement System (FRS) pension?

  It is the County’s understanding that in accordance with Florida Statutes §121.051, the independent Constitutional Officers are considered compulsory employers/participants in the FRS. Transferred employees will not lose their previously accrued FRS time and will continue to accrue time in the FRS in accordance with FRS rules. Employees are encouraged to contact the Florida Retirement System (FRS) to ask specific questions regarding their unique circumstances.

• Will I have the same health benefit plans and/or levels of coverage?

  Under the Mayor’s leadership, Miami-Dade County is developing transition agreements aimed at providing a smooth transition for the employees working in Departments that will transition to Constitutional Offices. Within these agreements, the Mayor is proposing that the County will continue to provide health benefits to affected employees through a period of time to avoid any coverage disruption. The new elected official will have the option of accepting this offer from the Mayor to simplify the transition or if not, the CO may still be required to provide continuing health benefits under the County’s plans if the collective bargaining agreements are determined to be binding on the CO. The aim of the Mayor is to provide continuity of benefits for employees while making the transition as smooth as possible. 

   

  Please note: The Sheriff's employees shall remain members of the County's health, dental and life insurance plans and maintain Workers' Compensation coverages until at least September 30, 2028, pursuant to an interlocal agreement required by Florida Statutes, §125.01015.

• What happens to my leave balances I have accrued?

  The Mayor plans to propose in the transition agreements with the Constitutional Officers that, in most cases, all leave balances transfer with each transferred employee (Non-Bargaining and Bargaining Unit employees).

• What happens to my longevity benefits?

  For transferred bargaining unit employees, the Mayor plans to propose that the Constitutional Officer accept the existing collective bargaining agreements (CBA) which would include the longevity benefits for transferred employees. The Constitutional Officer may accept the existing CBAs with these longevity benefits. If the CO does not accept the existing CBA, there is a legal process at the State level that may result in the existing CBA being declared binding on the CO until a new CBA is negotiated.

   

  For transferred non-bargaining unit employees, the Mayor plans to propose that the Constitutional Officer honor employee longevity benefits.

• Is there a guarantee I will be offered a job by the future constitutional officer?

  While there is no guarantee, the Mayor will propose to the appropriate Constitutional Officer that most, if not all, employees from the Affected Departments/Offices be transferred to the appropriate CO.

• What happens with the Collective Bargaining Agreement that applies to me?

  The Constitutional Officer may accept the existing CBA as binding to ensure a smooth transition. If the CO does not accept the existing CBA, there is a legal process at the State level that may result in the existing CBA being declared binding on the CO until a new CBA is negotiated.
